This Manufacturer’s Limited Hardware Warranty & Agreement (“Warranty”) is an agreement between you and TourBox Tech Inc. (“TourBox Tech,” “we,” or “us”).
PINALITASING OR USING YOUR TOURBOX TECH DEVICE, YOU AGREE TO THIS WARRANTY AND TO THE APPLICABLE TERMS AND CONDITIONS, POLICIES, AND DISCLAIMERS FOUND AT TOURBOX TECH’S WEBSITE. IF YOU DO NOT ACCEPT THIS WARRANTY, 1) DO NOT USE YOUR DEVICE; AND 2) RETURN YOUR DEVICE UNUSED TO TOURBOX TECH FOR A REFUND. IF YOU RETURN IT, THIS WARRANTY WILL GOVERN WHAT OCCURS BEFORE YOUR RETURN.

1.3 “Device Software” means the software supplied by TourBox Tech for use with the applicable Device and includes any authorized upgrades or supplements from Tour Box Tech for such software.

No one else may give any guarantee, warranty, or condition on TourBox Tech’s behalf.
3.3 If your local law gives you any implied warranty, including an implied warranty for merchantability, satisfactory quality, fitness for a particular purpose, workmanlike effort, title, or non-infringement, its duration is the same as this warranty. Some states, provinces (which may include the province of Quebec), or countries do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

5. TourBox Tech’s Responsibility

5.2 Unless a mandatory provision of your local law provides otherwise, after repair or replacement, your Device will be covered by this Warranty for the longer of the remainder of your original warranty period or 90 days after TourBox Tech ships it to you.
5.3 UNLESS AMANDATORY PROVISION OF YOUR LOCAL LAW PROVIDES OTHERWISE, TOURBOX TECH’S RESPONSIBILITY TO REPAIR OR REPLACE YOUR DEVICE, OR TO REFUND THE PURCHASE PRICE IS YOUR EXCLUSIVE REMEDY.
5.4 Subject to your local law (which may include the law of the Province of Quebec), if your Device malfunctions after one year (or other time in Section 2) from the date of original purchase or if your Device is otherwise excluded from this Warranty, Tour Box Tech may charge you a fee for its efforts (whether successful or not) to diagnose and service any problems with it,

6.3 Any device that has had its serial or IMEI number altered or removed.
6.4 Damage caused by any external cause (including for example, by being dropped, exposed to liquid or substance, or used with inadequate ventilation),
6.5 Damage caused by use not in accordance with the user manual or any other instruction Tour Box Tech provided,
6.6 Damage caused by repairs or modifications done by someone other than TourBox Tech or a TourBox Tech authorized service provider,
6.7 crutches, dents, other cosmetic damage, or damage reasonably expected as a result of normal wear and tear,
6,8 Damage caused by hacking, cracking, viruses or other malware, or by unauthorized access to services, accounts, computer systerns, or networks.
6.9 Any device that has had its software or hardware modified to alter its functionality or capabilities using malicious code, malware, pots, warns, trojans, backdoors, exploits, cheats, fraud, hacks, hidden diagnostics, or other mechanism,
6.10 Any behavior that disables security or content-protection mechanisms.
6. 11 Any behavior that deceives or defrauds TourBox Tech or others, or that may harm the device or our systems.
This Warranty applies only if your Device is used with software and updates recommended by Tour Box Tech.
This Warranty does not apply to (a) consumable parts designed to diminish overtime, unless the failure occurred due to a defecting materials or workmanship, or (bla SIM card or any cellular or other networks or system on which the Device operates,
This Warranty does not cover Device Software, and no warranty of any kind is provided with respect to Device Software, TourBox Tech does not guarantee that your use of the Device will be uninterrupted. timely, secure, or emor-free, or that data loss will not occur.
7. EXCLUSION OF CERTAIN DAMAGES AND LIMITATION OF LIABILITY – WAIVER
UNLESS OTHERWISE PROVIDED UNDER YOUR LOCAL LAW (WHICH MAY INCLUDE THE LAW OF THE PROVINCE OF QUEBEC), TOURBOX TECH IS NOT RESPONSIBLE FOR
7.1 ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.
7.2 ANY LOSS OF DATA, PRIVACY, CONFIDENTIALITY, OR PROFITS
7.3 ANY INABILITY TO USE YOUR DEVICE.
THESE EXCLUSIONS APPLY EVEN IF TOURBOX TECH HAS BEEN ADVISED OF THE POSSIBILITY OF THESE DAMAGES, AND EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE, SOME STATES, PROVINCES, AND COUNTRIES DO NOT ALLOW THE EXCLUSION OR

YOU UNDERSTAND THAT YOU MAY BE WAIVING RIGHTS WITH RESPECT TO CLAIMS THAT ARE AT THIS TIME UNKNOWN OR UNSUSPECTED, AND IN ACCORDANCE WITH SUCH WAIVER, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND, AND HEREBY EXPRESSLY WAIVE, THE BENEFITS OF SECTION 1542 OF THE CIVIL CODE OF CALIFORNIA, AND ANY SIMILAR LAW OF ANY STATE OR TERRITORY, WHICH PROVIDES AS FOLLOWS, “A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.”

Notwithstanding the foregoing, in the event of a conflict between the terms of this Warranty and the terms of the applicable agreements found on TourBox Tech’s website, the agreements found on TourBox Tech’s website will control.

10. BINDING ARBITRATION AND CLASS ACTION WAIVER IF YOU LIVE IN (OR, IF A BUSINESS, YOUR PRINCIPAL PLACE OF BUSINESS IS IN) THE UNITED STATES
We hope we never have a dispute, but if we do, you and we agree to try for 60 days to resolve it informally. If we cannot resolve our dispute, you and we agree to binding individual arbitration before the American Arbitration Association (“AAA”) under the Federal Arbitration Act (“FAA”), and not to sue in court in front of a judge or jury, Instead, a neutral arbitrator will decide, and the arbitrator’s decision will be final except for a limited right of review under the FAA, Class action lawsuits, class-wide arbitrations, private attorney-general actions, and any other proceeding where someone acts in a representative capacity are not allowed; neither is allowed to combine individual proceedings without the consent of all parties.
10.1 Disputes Covered-Everything Except IP. The term “dispute” includes any claim or controversy between you and TourBox Tech concerning the Device, its price, advertising, marketing, communications, your purchase transaction, billing, or this Warranty under any legal theory including contract, warranty, tort, statute, or regulation, except disputes relating to the enforcement or validity of your, your licensors’, our, or our licensors’ intellectual property rights.
10.2 Mail Notice of Dispute First. If you have a dispute and our customer service representatives can’t resolve it, send a Notice of Dispute by email to support@tourboxtech.com. Tell us your name, address, how to contact you, what the problem is, and how we can help. We will do the same if we have a dispute with you. After 60 days, you or we may start an arbitration if the dispute is unresolved.
10,3 Small Claims Court Option. Instead of mailing a Notice of Dispute, you may sue us in small claims court in your county of residence (or, if a business, your principal place of business) or in Santa Clara County, California, if you meet the court’s requirements.
10.4 Arbitration Procedure. The AAA will conduct any arbitration under its Commercial Arbitration Rules (or its Consumer Arbitration Rules if you are an individual and use the Device for personal or household use, or if the value of the dispute is $75,000 or less regardless of whether you are an individual or how you use the Device). For more information, see www.adr.org o tawag sa 1-800-778-7879. To start an arbitration, submit the form available at aka.ms/us-arbitration to the AAA and mail a copy to TourBox Tech. In a dispute involving $25,000 or less, any hearing will be telephonic unless the arbitrator finds good cause to hold an in-person hearing instead. Any in-person hearing will take place in your county of residence (or, if a business, your principal place of business) or Santa Clara County, California. The arbitrator may award the same damages to you individually as a court could. The arbitrator may award declaratory or injunctive relief only to you individually to satisfy your individual claim. Under AAA Rules, the arbitrator rules on his or her own jurisdiction, including the arbitrability of any claim.
10.5 Arbitration Fees and Payments
a) Disputes Involving $75,000 Or Less. TourBox Tech will promptly reimburse your filing fees and pay the AAA’s and arbitrator’s fees and expenses. If you reject our last written settlement offer made before the arbitrator was appointed, your dispute goes all the way to an arbitrator’s decision (called an “award”), and the arbitrator awards you more than this last written offer, we will do the following: (i) pay the greater of the award or $1,000; (ii) pay your reasonable attorney’s fees, if any; and (iii) reimburse any expenses (including expert witness fees and costs) that your attorney reasonably accrues for investigating, preparing, and pursuing your claim in arbitration.
b) Disputes Involving More Than $75,000. The AAA rules will govern payment of filing fees and the AAA’s and arbitrator’s fees and expenses.
c) Must File within One Year. You and we must file in small claims court or arbitration any claim or dispute (except intellectual property disputes-see Section 11(a)) within one year from when it first could be filed. Otherwise, it is permanently barred.
d) Severability. If any part of Section 11 (Binding Arbitration and Class Action Waiver) is found to be illegal or unenforceable, the remainder will remain in effect (with an arbitration award issued before any court proceeding begins), except that if a finding of partial illegality or unenforceability would allow class-wide or representative arbitration, Section 11 will be unenforceable in its entirety.
e) Conflict with AAA Rules. This Warranty governs if it conflicts with the AAA’s Commercial Arbitration Rules or Consumer Arbitration Rules.
